Rada adopts draft law on forced evacuation of children from combat zone as basis

Today, on February 11, the Verkhovna Rada adopted as a basis the draft law No. 12353 on the mandatory evacuation of children from the combat zone.

According to Censor.NET, this was reported by MP Yaroslav Zhelezniak of the Voice party.

He noted that the bill was supported by 275 MPs.

The explanatory note to the draft law states that the purpose of the draft Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine Regarding the Settlement of the Issue of Mandatory Evacuation" is to improve the legislation in force in the field of civil protection, the legal regime of martial law and family law, to increase the efficiency of the implementation of state policy on the organization of evacuation measures, namely, to regulate the issue of mandatory evacuation of children.

Thus, the draft law provides for amendments to the Civil Protection Code in part:

  • Regulation of the mandatory evacuation of children who find themselves in areas of military (combat) operations, areas of armed conflict and settlements close to areas of combat operations;

  • clarifying the powers of public authorities in carrying out evacuation measures, including mandatory evacuation;

  • eliminating the gap regarding the prohibition or restriction of entry (entry), stay of the population in settlements from which mandatory evacuation is carried out;

  • Amendments to the Law of Ukraine "On the Legal Regime of Martial Law" to clarify the measures of the legal regime of martial law related to the implementation of civil protection measures during a special period;

  • amendments to the Family Code of Ukraine and the Law of Ukraine "On Protection of Childhood" in terms of:
    the obligations of parents (or persons in loco parentis) to take care of the child's safe living conditions for the period of martial law;

  • the obligation of parents (or persons in loco parentis) to comply with the decisions of military administrations to take measures to carry out compulsory evacuation of children;

  • clarifying the rights, duties and responsibilities of parents for the upbringing and development of their children.
