Indictment against Defense Ministry officials for procurement of helmets and armored vests in 2014-2015 sent to court

The Main Military Prosecutor's Office sent to the court the indictments against five former and current officials of the Ministry of Defense and two officials of a business entity, whose actions caused damage to the defense department amounting to more than 34 million UAH ($1.33 million).

"The main military prosecutor's office has completed the pretrial investigation in the criminal proceedings on the facts of seizing state funds in particularly large amounts and negligence in the implementation in 2014-2015 of state purchases of helmets and body armor for the needs of the Armed Forces of Ukraine, which entailed grave consequences.
"During the investigation, more than 100 people were questioned, more than 3,000 documents seized and examined, nearly 30 audits and complex forensic examinations were conducted.
"Based on the collected evidence, five former and current heads of the Department of Public Procurement and Supply of Material Resources of the Ministry of Defense of Ukraine were indicted of committing crimes under Part 2 of Article 367 (official negligence) and Part 2 of Art. 425 (negligent attitude towards military service ) of the Criminal Code of Ukraine.
"As established by the pretrial investigation, these persons, fulfilling (each at different times) the duties of the director of the Department of Public Procurement and Supply of Material Resources of the Ministry of Defense and the head of the financial administration of the same Department, contrary to the requirements of the legislation on the exemption from VAT of helmets and body armor for the needs of the Armed Forces of Ukraine, signed a number of contracts for the supply of such special means of personal protection at a price that included VAT.
"On the basis of the payment orders signed by them, the Ministry of Defense illegally paid a total of 32.6 million UAH in the form of value-added tax to the account of the supplier enterprise during 2014-2015.
"Moreover, additional agreements to individual contracts unjustifiably increased the price of helmets and body armor supplied, which led to unnecessary expenses of the Ministry for a total of more than 1.5 million UAH.
"In the same criminal proceeding, an indictment of committing a crime under part 5 of Article 119 of the Criminal Code of Ukraine (seizure of property by abuse of official position in especially large amounts) was served to a shareholder and director and chief accountant of the supplier enterprise who appropriated the means of the Ministry of Defense in the amount of 34.1 million UAH.
"The indictments with respect to all these persons have been sent to court.
"In order to ensure compensation for damage, the property of the accused persons has been seized," the report reads.
